Under 40 CFR 112 (SPCC Rule), facilities storing 1,320 gallons or more of oil in ASTs (each container ≥ 55 gal) that present a reasonable expectation of discharge into navigable waters—such as the James River, which flows directly through Richmond—must prepare and implement an SPCC Plan. That plan must be supported by documented inspections of tanks, piping, valves, and containment systems to demonstrate ongoing operational integrity.
Virginia maintains one of the most comprehensive state-level AST programs in the country. Under 9VAC25-91 (Facility and Aboveground Storage Tank Regulation), administered by the Virginia Department of Environmental Quality's Tank Compliance Program under authority of Article 11 of the State Water Control Law, operators must register individual ASTs with a capacity greater than 660 gallons or any facility with an aggregate capacity greater than 1,320 gallons of oil; registration must be renewed every five years or upon change of ownership. Facilities at or above the 25,000-gallon threshold are subject to additional pollution prevention standards, Oil Discharge Contingency Plan (ODCP) requirements, and formal internal and external inspections conducted in accordance with API Standard 653 or STI SP001 (Fifth Edition)—or a department-approved equivalent—with API 570 accepted for associated piping. State regulation (9VAC25-91-130 B 5) further requires daily visual inspections and periodic checklist inspections for qualifying facilities. Newly installed ASTs must receive an initial formal inspection within five years of installation. Inspections must be performed by or certified by qualified inspectors per the applicable API or STI standards.
