Under 40 CFR 112 (SPCC Rule), facilities in San Antonio storing an aggregate of 1,320 gallons or more of oil in aboveground tanks—each container 55 gallons or greater—and with a reasonable potential for discharge into navigable waters such as the San Antonio River and its tributary creeks flowing through Bexar County must prepare and implement an SPCC Plan. That plan must include documented inspections of tanks, piping, valves, and secondary containment systems to demonstrate ongoing spill prevention.
Texas maintains one of the most layered AST regulatory frameworks in the country. Under 30 TAC Chapter 334, Subchapter F, administered by the Texas Commission on Environmental Quality (TCEQ) Petroleum Storage Tank Program, petroleum motor-fuel ASTs with capacity greater than 1,100 gallons must be registered with TCEQ and are subject to construction notification, release reporting, recordkeeping, and general operational requirements. A second layer—the Aboveground Storage Vessel Safety (ASVS) Program under 30 TAC Chapter 338, adopted in 2023—imposes safety performance standards and mandatory registration by September 1, 2027 for large ASVs (21,000 gallons or greater) at petrochemical plants, petroleum refineries, and bulk storage terminals. Because San Antonio sits within the Edwards Aquifer recharge and transition zone, TCEQ also requires a facility-specific AST Facility Plan for permanent tanks with 500 gallons or more of aggregate hydrocarbon or hazardous-substance capacity. The City of San Antonio further requires a $330 construction permit for each permanent AST storing flammable or combustible liquids under its 2024 IFC-based Fire Code amendments (effective May 1, 2025). Inspections are commonly performed under STI SP001 for shop-built tanks and API 653 for field-erected tanks, with inspection intervals governed by applicable SPCC Plan requirements and the ASVS Program standards.
