Under 40 CFR 112 (SPCC Rule), facilities in the Beckley area that store 1,320 gallons or more of oil in aboveground tanks (each container ≥ 55 gal) and present a reasonable expectation of discharge into navigable waters—such as the New River and its tributaries flowing through Raleigh County—must prepare and maintain an SPCC Plan. That plan must include documented inspections of tanks, piping, valves, and secondary containment systems to demonstrate ongoing spill prevention readiness.
West Virginia is among the most comprehensive state AST programs in the country. Under W. Va. Code §22-30 and its implementing rule 47 CSR 63, administered by the West Virginia Department of Environmental Protection, Division of Water and Waste, Tanks Unit, all ASTs holding more than 1,320 gallons must be registered with WVDEP and obtain a certificate to operate. Regulated tanks are classified as Level 1 or Level 2 based on proximity to public water supply sources, with higher standards applied to Level 1 tanks. Annual certification is explicitly required by state regulation (47 CSR 63-5.2): qualified-person inspections by a WV-licensed PE, a person under direct PE supervision, or an API- or STI-certified inspector are required on a 3-year cycle for Level 1 ASTs and a 5-year cycle for Level 2 ASTs, with owner/operator self-certification permissible in intervening annual years. Routine visual inspections of secondary containment are required every 14 days for Level 1 tanks and monthly for Level 2 tanks. Owners must also submit Spill Prevention Response Plans, and operating an unregistered AST is unlawful and subject to civil penalties up to $10,000 per tank per day.
