Under 40 CFR 112 (SPCC Rule), facilities storing 1,320 gallons or more of oil in ASTs (each container ≥ 55 gal) and with a reasonable expectation of discharge into navigable waters—such as the Elizabeth River, which borders Norfolk and flows into the Chesapeake Bay—must maintain an SPCC Plan. This includes documented inspections of tanks, piping, valves, and containment systems to reduce the risk of oil reaching these federally recognized navigable waters.
Under Virginia's 9VAC25-91 (Facility and Aboveground Storage Tank Regulation), administered by the Virginia Department of Environmental Quality's Tank Compliance Program, AST owners must register any individual tank with a capacity greater than 660 gallons of oil—or any facility with aggregate capacity exceeding 1,320 gallons—with DEQ, with renewal required every five years or upon change of ownership. Facilities at or above 25,000 gallons are subject to additional pollution prevention standards, including daily visual checks and periodic formal inspections. Formal internal and external inspections must be conducted in accordance with API Standard 653 or STI SP001 (Fifth Edition), or a department-approved equivalent, with API 570 accepted for associated piping; newly installed ASTs must receive an initial formal inspection within five years of installation. Virginia's program also requires Oil Discharge Contingency Plans for qualifying facilities and operates independently of the federal SPCC Rule, which applies in parallel.
