Under 40 CFR 112 (SPCC Rule), facilities storing 1,320 gallons or more of oil in ASTs (each container ≥ 55 gal) that present a reasonable expectation of discharge into navigable waters—such as the Southern Branch of the Elizabeth River, which flows through Chesapeake and is recognized as a navigable water of the United States by the U.S. Army Corps of Engineers—must maintain an SPCC Plan. That plan must include documented inspections of tanks, piping, valves, and containment systems, and be prepared or certified by a licensed Professional Engineer for qualifying facilities.
Virginia maintains one of the most comprehensive, standalone AST regulatory programs in the country. Under 9VAC25-91 (Facility and Aboveground Storage Tank Regulation), administered by the Virginia Department of Environmental Quality, Tank Compliance Program, any individual AST storing more than 660 gallons of oil—or any facility with aggregate capacity exceeding 1,320 gallons—must be registered with DEQ, with registration renewed every five years or upon change of ownership. Facilities at or above 25,000 gallons of aggregate capacity are subject to additional pollution prevention standards, including Oil Discharge Contingency Plans and routine daily visual and weekly checklist inspections. Formal internal and external tank inspections must be conducted in accordance with API Standard 653 or STI SP001 (Fifth Edition), or a department-approved equivalent, on the cycle set by those standards; newly installed ASTs must receive an initial formal inspection within five years of installation. Associated piping inspections may be conducted under API 570. All formal inspections must be performed by, or certified by, inspectors qualified under the applicable standard.
