Under 40 CFR 112 (SPCC Rule), facilities storing 1,320 gallons or more of oil in ASTs (each container ≥ 55 gal) that have a reasonable possibility of discharge into navigable waters—such as the Colorado River, which bisects Austin and flows southeast to Matagorda Bay on the Gulf of Mexico—must maintain an SPCC Plan. That plan must include documented inspections of tanks, piping, valves, and secondary containment systems to demonstrate ongoing spill-prevention compliance.
Texas has one of the more layered AST regulatory frameworks in the country, administered by the Texas Commission on Environmental Quality (TCEQ) Petroleum Storage Tank Program. Under 30 TAC Chapter 334, Subchapter F, petroleum motor-fuel ASTs with a capacity greater than 1,100 gallons must be registered with TCEQ and are subject to construction notification requirements at least 30 days before installation (§ 334.126–127), along with release-reporting, recordkeeping, and general operational prohibitions. A separate Aboveground Storage Vessel Safety (ASVS) Program under 30 TAC Chapter 338—effective August 24, 2023—imposes safety performance standards, mandatory registration by September 1, 2027, and self-certification requirements on large ASVs (≥ 21,000 gallons) at petrochemical plants, petroleum refineries, and bulk storage terminals. No state-mandated periodic inspection frequency is established under 30 TAC Chapter 334 Subchapter F for routine petroleum ASTs; inspection intervals for oil-storage facilities subject to federal requirements are governed by the facility's SPCC Plan. Inspections are commonly performed under STI SP001 (shop-built tanks) or API 653 (field-erected tanks). Additionally, because Austin lies in Travis County, ASTs located in the Edwards Aquifer recharge or transition zone may require a separate TCEQ AST Facility Plan under 30 TAC Chapter 213, and the City of Austin directs AST hazardous-materials permitting through the Austin Fire Department under Austin Code of Ordinances § 6-2-3.
