Under 40 CFR 112 (SPCC Rule), facilities storing 1,320 gallons or more of oil in ASTs (each container ≥ 55 gal) and with a reasonable expectation of discharge into navigable waters—such as the Allegheny, Monongahela, and Ohio Rivers that converge at Pittsburgh—must maintain an SPCC Plan. This includes documented inspections of tanks, piping, valves, and containment systems to prevent spills from reaching these federally navigable waterways.
Pennsylvania's Storage Tank and Spill Prevention Act (Act 32 of 1989) and its implementing regulations at 25 Pa. Code Chapter 245, Subchapters F and G (§§245.501–245.601), administered by the Pennsylvania Department of Environmental Protection's Bureau of Clean Water—Division of Storage Tanks, establish one of the most comprehensive standalone AST programs in the nation. Regulated ASTs (capacity greater than 250 gallons, with more than 90% of volume aboveground, storing regulated substances) must be registered with DEP, hold an operating permit, and pay an annual registration fee—operating without registration is unlawful. State law mandates in-service inspections by a DEP-certified tank inspector at least every five years, out-of-service inspections at least once every 20 years, and monthly maintenance inspections by the owner or operator. All construction and tank handling work must be performed by a DEP-certified tank handler/installer. Facilities with total AST capacity exceeding 21,000 gallons must also submit a Spill Prevention Response Plan to DEP. Inspections are commonly conducted under STI SP001 (shop-built tanks) or API 653 (field-erected tanks).
