Under 40 CFR 112 (SPCC Rule), facilities storing 1,320 gallons or more of oil in aboveground storage tanks (each container ≥ 55 gal) that present a reasonable expectation of discharge into navigable waters—such as Lake Mead and the Colorado River, which receive drainage from the Las Vegas Valley—must maintain an SPCC Plan. That plan must include documented inspections of tanks, piping, valves, and secondary containment systems to demonstrate ongoing spill prevention readiness.
Nevada does not maintain AST-specific technical regulations for most aboveground tanks. As NDEP explicitly states, its storage tank program (NAC 459.9921–459.999) focuses on underground storage tanks and a narrow carve-out for marina ASTs (NAC 459.99285, NAC 459.9931–9938), which face mandatory registration and International Fire Code-based secondary containment requirements. All other ASTs in Nevada are governed primarily by the federal SPCC Rule (40 CFR 112) and, for fire and safety requirements, the Nevada State Fire Marshal's Fire Code (NAC 477), which adopts the International Fire Code by reference. Inspections are commonly performed under STI SP001 (shop-built tanks) or API 653 (field-erected tanks).
