Under 40 CFR 112 (SPCC Rule), facilities storing 1,320 gallons or more of oil in ASTs (each container ≥ 55 gal) and with a reasonable expectation of discharge into navigable waters—such as the Platte River, formed at the confluence of the North Platte and South Platte Rivers directly at North Platte—must maintain an SPCC Plan. Additionally, North Platte City Code § 94.056 imposes local zoning and permitting requirements on AST siting—including conditional use permits in I-2 heavy industrial districts and Fire Chief-issued permits in certain other zones—and requires facility operators to provide a complete tank inventory and Safety Data Sheets to the North Platte Fire Department.
