Under 40 CFR 112 (SPCC Rule), facilities storing 1,320 gallons or more of oil in ASTs (each container ≥ 55 gal) and with a reasonable potential to discharge into navigable waters—such as the Missouri River, which borders Bismarck to the west—must maintain an SPCC Plan. That plan must include documented inspections of tanks, piping, valves, and containment systems to demonstrate ongoing spill-prevention compliance.
North Dakota enacted dedicated AST statutory authority under N.D. Cent. Code ch. 23.1-04.1 (via HB 1058, 2025), with implementing rules in N.D. Admin. Code ch. 33.1-13-01, administered by the North Dakota Department of Environmental Quality, Division of Waste Management – AST Program. The rules address leak detection, secondary containment, release reporting, and corrective action for petroleum ASTs. NDAC 33.1-13-01 requires monthly visual inspections of tanks, piping, and containment, along with periodic leak-detection testing; tank integrity tests must be conducted in accordance with STI SP001 or API 653 per N.D.C.C. § 23.1-12-02(17). Owners and operators must also register with the Petroleum Tank Release Cleanup Fund (PTRCF) under N.D.C.C. ch. 23.1-12, with annual per-tank fees required for cleanup-fund eligibility. The State Fire Marshal separately enforces NFPA 30/30A fire-safety standards under NDAC 10-07. In addition, the City of Bismarck requires a Fire Department permit for aboveground fuel tank installations under IFC 105.6.8, and restricts AST placement to approved zoning districts with a 400-foot setback from residential areas.
