Under 40 CFR 112 (SPCC Rule), facilities storing 1,320 gallons or more of oil in aboveground storage tanks (each container ≥ 55 gal) that have a reasonable expectation of discharge into navigable waters—such as the St. Louis River and Lake Superior, which together form the federally recognized Duluth-Superior Harbor—must maintain an SPCC Plan. That plan must include documented inspections of tanks, piping, valves, and containment systems, and be prepared or certified by a licensed Professional Engineer.
Minnesota maintains one of the most comprehensive state-level AST programs in the country. Under Minn. R. Chapter 7151 (Aboveground Storage of Liquid Substances) and Minn. Stat. § 116.46–116.491, administered by the Minnesota Pollution Control Agency (MPCA), commercial AST systems storing petroleum or hazardous substances are subject to detailed requirements covering design, secondary containment, corrosion protection, leak detection, overfill prevention, monitoring, and closure. Owners of ASTs of 500 gallons or more must notify the MPCA within 30 days of installation under Minn. Stat. § 116.48—a mandatory operational requirement. Minn. R. 7151 requires monthly visual inspections of all tanks and containment areas, with leak detection checks required every 72 hours or weekly depending on containment type. Facilities with total AST capacity under one million gallons are governed by the Chapter 7151 rules; those at or above one million gallons require an individual MPCA major facility permit. For field-erected steel tanks, MPCA requires inspection by an API 653 Certified Inspector and submission of the API 653 Inspection Summary form after each inspection; inspection intervals for field-erected tanks vary per API 653 based on tank design, contents, and age. Shop-built tanks are commonly inspected under the STI SP001 standard.
