Under 40 CFR 112 (SPCC Rule), facilities storing 1,320 gallons or more of oil in ASTs (each container ≥ 55 gal) that have a reasonable expectation of discharge into navigable waters—such as the Monocacy River, which flows through Frederick County before joining the Potomac—must maintain an SPCC Plan. That plan requires documented inspections of tanks, piping, valves, and containment systems to prevent oil from reaching waters of the United States.
Maryland is one of a small number of states with a dedicated, standalone AST technical regulatory program. Under COMAR 26.10.17 (shop-fabricated ASTs) and COMAR 26.10.18 (field-erected ASTs), administered by the Maryland Department of the Environment (MDE) Oil Control Program, all regulated AST systems at facilities with more than 2,500 gallons of aboveground aggregate oil storage must be registered with MDE under COMAR 26.10.01.10. Facilities with 10,000 gallons or more (or 1,000 gallons or more of used oil, or marinas) must also obtain an Individual Oil Operations Permit under COMAR 26.10.01.09. State rules mandate at least monthly visual inspections and annual vent inspection and cleaning under COMAR 26.10.17.12 and 26.10.18.11, following STI/SPFA SP001 monthly and annual checklists; formal external and internal inspection intervals for permitted facilities are set by STI SP001 Section 5.0 based on tank size and category, and must be conducted by a certified inspector. These Maryland requirements apply in addition to—and are often more stringent than—the federal SPCC Rule.
