Under 40 CFR 112 (SPCC Rule), facilities storing 1,320 gallons or more of oil in aboveground storage tanks (each container ≥ 55 gal) and with a reasonable expectation of discharge into navigable waters—such as the Patapsco River and Baltimore Harbor—must maintain an SPCC Plan. This includes documented inspections of tanks, piping, valves, and containment systems to prevent releases from reaching these federally protected waterways.
Maryland maintains one of the most comprehensive state-level AST regulatory programs in the country, administered by the Maryland Department of the Environment (MDE) Oil Control Program under COMAR 26.10.17 (shop-fabricated ASTs), COMAR 26.10.18 (field-erected ASTs), and COMAR 26.10.01.10. Facilities with more than 2,500 gallons of aboveground aggregate oil storage must register all AST systems with MDE, while those at or above 10,000 gallons (or meeting other thresholds) must obtain an Individual Oil Operations Permit under COMAR 26.10.01.09. All regulated ASTs are subject to monthly visual inspections and annual vent inspection and cleaning as state-mandated requirements; formal external and internal inspection intervals for permitted facilities are set by STI SP001 Section 5.0 based on tank size and category—not a single flat cycle. Formal inspections must be conducted by a certified inspector, and these state requirements apply in addition to, and are often more stringent than, the federal SPCC Rule. Inspections are commonly performed under STI SP001 for shop-fabricated tanks and API 653 for field-erected tanks.
