Under 40 CFR 112 (SPCC Rule), facilities storing 1,320 gallons or more of oil in ASTs—where each container holds 55 gallons or more—and with a reasonable potential to discharge into navigable waters such as the Severn River or its tidal tributaries around Annapolis must maintain a written SPCC Plan. That plan must be supported by documented inspections of tanks, piping, valves, and containment systems to demonstrate ongoing compliance and spill prevention readiness.

Maryland's COMAR 26.10.17 (shop-fabricated ASTs) and COMAR 26.10.18 (field-erected ASTs), administered by the Maryland Department of the Environment (MDE) Oil Control Program, established a comprehensive standalone AST regulatory program effective June 13, 2022. Facilities with more than 2,500 gallons of aboveground aggregate oil storage must register all AST systems with MDE under COMAR 26.10.01.10; facilities at or above 10,000 gallons (or 1,000 gallons of used oil, or marinas) must also obtain an Individual Oil Operations Permit under COMAR 26.10.01.09. State-mandated monthly visual inspections and annual vent inspection and cleaning are required under COMAR 26.10.17.12 and 26.10.18.11, following STI SP001 monthly and annual checklists. Formal external and internal inspection intervals for permitted facilities are determined by tank size and category per STI SP001 Section 5.0 and must be conducted by a certified inspector. These state requirements apply in addition to, and are often more stringent than, the federal SPCC Rule. Facilities in Anne Arundel County should also note that a county-level building permit is required for the aboveground storage of fuel oil, gasoline, diesel, or other liquids prior to installation.

API 653 inspections are required for large, field-erected aboveground storage tanks (ASTs) that are constructed to the API 650 standard. In Annapolis, these tanks are commonly used by petroleum terminals, manufacturing plants, chemical facilities, and utilities to store fuel, oil, or hazardous liquids. If your tank is over 75,000 gallons, made from welded-steel construction, has a diameter of 30 feet or more, or a height of 50 feet or more, there's a high likelihood it falls under API 653 requirements.
STI SP001 inspections are typically required for shop-fabricated aboveground storage tanks under 75,000 gallons, often found at gas stations, commercial facilities, and industrial properties. If you're storing oil or hazardous substances in Annapolis, you may be subject to the EPA's Spill Prevention, Control, and Countermeasure (SPCC) rules for this inspection.
