Under 40 CFR 112 (SPCC Rule), facilities storing 1,320 gallons or more of oil in ASTs (each container ≥ 55 gal) that present a reasonable possibility of discharge into navigable waters—such as the Blackstone River, which originates in Worcester and flows southeast toward Narragansett Bay—must maintain an SPCC Plan. That plan must include documented inspections of tanks, piping, valves, and containment systems to demonstrate ongoing compliance with federal spill prevention standards.
Massachusetts maintains one of the most comprehensive standalone AST regulatory programs in the country under 502 CMR 5.00 and M.G.L. c. 148, § 37, administered by the Massachusetts Department of Fire Services, Office of the State Fire Marshal. The regulation applies to all ASTs greater than 10,000 gallons storing any fluid other than water, requiring a construction permit before installation and a Use Permit to operate—renewed every five years upon successful compliance inspection. Annual inspections are explicitly required by 502 CMR 5.05 as a condition of maintaining the Use Permit, and must follow a Marshal-approved Approved Standard, typically STI SP001 (for shop-built tanks) or API 653 (for field-erected tanks). Inspections must be conducted by a Qualified Tank Inspector: a Massachusetts Registered Professional Engineer, an API 653 Inspector, an STI SP001 AST Certified Tank Inspector, an SP9000/SP9100 FRPI Inspector, an ASME Pressure Vessel Inspector, or an Alternative Qualified Inspector approved by the Marshal. ASTs at or below 10,000 gallons fall outside 502 CMR 5.00 and are governed by the federal SPCC Rule.
