Under 40 CFR 112 (SPCC Rule), facilities in Lowell storing 1,320 gallons or more of oil in aboveground storage tanks (each container ≥ 55 gal) and with a reasonable potential to discharge into navigable waters—such as the Merrimack River, which flows through the heart of the city—must develop and maintain an SPCC Plan. That plan must include documented inspections of tanks, piping, valves, and containment systems to demonstrate ongoing operational integrity and environmental accountability.
Under Massachusetts's standalone AST regulation, 502 CMR 5.00, adopted pursuant to M.G.L. c. 148, § 37 and administered by the Massachusetts Department of Fire Services, Office of the State Fire Marshal, any AST greater than 10,000 gallons storing a non-water fluid requires both a construction permit prior to installation and a Use Permit to operate. ASTs at or below 10,000 gallons fall outside the scope of 502 CMR 5.00 and are governed by the federal SPCC Rule.
