Under 40 CFR 112 (SPCC Rule), facilities storing 1,320 gallons or more of oil in aboveground storage tanks (each container ≥ 55 gal) and with a reasonable expectation of discharge into navigable waters—such as the Kansas River (Kaw) or its tributary Mill Creek, which originates in Olathe—must prepare and implement an SPCC Plan. That plan must include documented inspections of tanks, piping, valves, and containment systems to demonstrate ongoing spill prevention readiness.
Kansas regulates ASTs under the Kansas Storage Tank Act (KSA 65-34) and K.A.R. 28-44-29, administered by the Kansas Department of Health and Environment (KDHE), Bureau of Environmental Remediation, Storage Tank Section, in coordination with the Kansas State Fire Marshal's Office (KSFMO). K.A.R. 28-44-29(b) requires a valid annual operating permit for all regulated ASTs containing petroleum or other regulated substances; permits run August 1 through July 31 and must be renewed by December 31, with a $10-per-tank annual fee. New ASTs storing flammable or combustible liquids must obtain KSFMO fire-code approval before KDHE issues the operating permit. Kansas does not impose a state-mandated periodic inspection frequency or inspector qualification standard for routine AST inspections; for SPCC-covered facilities, inspection content and qualifications are governed by the facility's own SPCC Plan under federal requirements. Inspections are commonly performed under STI SP001 (shop-built tanks) or API 653 (field-erected tanks). Within Olathe city limits, Olathe Municipal Code § 16.05.380 (Ord. 12-52, 2012) establishes additional zoning-district limits on aboveground storage of flammable liquids.
