Under 40 CFR 112 (SPCC Rule), facilities storing 1,320 gallons or more of oil in ASTs (each container ≥ 55 gal) and with a reasonable expectation of discharge into navigable waters—such as the Ohio River, which forms Evansville's southern boundary and is one of the nation's principal commercial waterways—must maintain an SPCC Plan. That plan must include documented inspections of tanks, piping, valves, and containment systems to demonstrate ongoing spill prevention readiness.
Indiana maintains a genuine but limited set of AST-specific state requirements administered by multiple agencies. Under IC 13-23, regulated ASTs storing petroleum or hazardous substances in the 1,500–20,000 gallon range must be registered with IDEM's Office of Land Quality—a requirement in effect since July 1, 2023. IDEM's Secondary Containment Rule (327 IAC 2-10) separately requires secondary containment and a spill response plan for liquid hazardous materials stored in ASTs. Flammable and combustible liquid storage is governed by the 2014 Indiana Fire Code (675 IAC 22-2.5, Chapter 57), administered by the Indiana State Fire Marshal, which incorporates NFPA 30 standards; the State Fire Marshal also conducts plan reviews for such tanks. Fertilizer and pesticide ASTs fall under the Office of Indiana State Chemist, regulated separately under 355 IAC 2 and 355 IAC 5. Indiana has no state-mandated periodic inspection frequency or technical inspection standard for petroleum ASTs equivalent to API 653 or STI SP001; integrity management for those tanks defaults to the facility's SPCC Plan under federal rules. Inspections are commonly performed under STI SP001 (shop-built tanks) or API 653 (field-erected tanks).
