Under 40 CFR 112 (SPCC Rule), facilities storing 1,320 gallons or more of oil in aboveground storage tanks (each container ≥ 55 gal) and with a reasonable potential to discharge into navigable waters—such as the South Platte River and its tributary Cherry Creek, which converge at Confluence Park in the heart of the city—must maintain an SPCC Plan. That plan must include documented inspections of tanks, piping, valves, and containment systems to demonstrate ongoing spill prevention and response readiness.
Colorado's Division of Oil and Public Safety (OPS) administers a dedicated AST technical program under 7 CCR 1101-14, Article 3, covering petroleum ASTs between 660 and 39,999 gallons. The regulations—last updated effective January 1, 2025—set minimum standards for design, construction, installation, operation, release detection, and closure of AST systems. OPS requires monthly visual inspections of ASTs, secondary containment tanks, and piping to detect leakage; those monthly inspections can be satisfied by completing the monthly, annual, and periodic inspections required by STI SP001. All regulated ASTs must be registered with OPS within 30 days of being placed into service, with a $35 annual registration fee per tank. Beginning January 1, 2027, AST installers must hold certification issued by the OPS Director, and STI SP001 is an accepted compliance pathway for required periodic inspections. OPS also conducts its own field inspections, and financial responsibility is separately required under C.R.S. § 8-20.5-303.
